What is a Legal Seperation in Divorce?
Just like people decide on marriage, deciding a divorce is not an easy and simple matter to go through. There are a lot of process and procedure. Still those procedures sometimes even useful and make a broken couple getting their relationship back and start over their marriage.
One of the procedures is a legal seperation . Legal seperation is the last stage of divorce process that is obliged by court after they fill out a divorce forms. In this period, the couples are still a husband and a wife but do not have any responsibility to each other. The length of time for this period usually one year. During which time, it is decided by court about the place where the children should live, any debts and property settlements. Of course, these matters require much time. This legal seperation sometimes becomes the best solution for couples for various considerations such as religious beliefs and insurance purposes.
In fact, many couples are able to think clearly about the state of their relationship during this period. They start to contemplate and some even decide to cancel the divorce process that has been going on. For those who clearly want the divorce can proceed with the process one year after the legal seperation is granted. Only at that time, one party is enough to settle up the divorce. It means that the legal seperation period does not help them to sort things out. There is no need for further hearings and the other party cannot do anything else to stop the process. The marriage is therefore terminated.
Even so, the couple still has the responsibility to handle the situation with their children and settle down their marital debts and property. Any debts in their marital life usually divided into two. Each party has a responsibility to pay off half of the total amount. But always remember, do not dismiss your divorce rights.
So, what is considered to be the marital property? It is actually anything that the couples buy and bring home during the time they marry. It does not matter in whose name the property is listed as long as it is bought and brought home during the marital period; they belong to each other and should be divided fairly. This kind of division sometimes brings its own problem to the process. The court will determine the process, though. Yet, the present of attorney from each party is needed to prevent unwanted dispute over the matter in the future.
